Basic requirements and procedure of trademark in Nepal
Filing Requirements
- Full Name and Address of Applicant.
- Specimen of the trademark (word mark or logo).
- Original Signed and Stamped Power of Attorney with the indication of the name and positions of the signatory. Legalization and notarization are required.
- Certified copy of priority documents with English translation is required if priority is claimed. (can be filed within 6 months form the filing date).
- List of Goods/Service must be same mentioned in the corresponding registration certificate.
- Certified copy of Corresponding Registration Certificate along with English Translation. (Legalization and notarization are required).
Registration Procedure
After Competition filing procedure, the trademark goes to formalities and substantive examination, the Registrar examines the trademark similarity with existing registered trademarks with the requirements of the Law. If the examiner accepted the mark, then the mark is published in the Nepalese IP journal (IP Bulletin) for opposition purposes (opposition period is three months (90 days) from the publication date) where, there is no opposition filed by third party, the register issuance a certificate of registration for the seven years (7) from the date of registration.
